我国代孕法律制度研究

摘要
就各国的立法来看,总体上,代孕制度经历了从概括的禁止代孕向有限制的开放代孕转变。很显然,目前我国对待代孕所持的态度还是相当保守的,可是,近来代孕纠纷频发,我国急需对代孕制度进行调整完善,通过严格限定委托夫妻与代孕母亲的资格等措施,建立起以自愿、有效监督管理、非营利性为原则的代孕法律制度。
In terms of national legislation,the surrogacy system has generally undergone a shift from ageneral prohibition of surrogacy to a limited open surrogacy.Obviously,our attitude towards surrogacy is still quite conservative.However,surrogacy disputes are frequent recently.China urgently needs to adjust and perfect the surrogacy system,and adopt measures such as strictly limiting the qualifications of entrusted couples and surrogate mothers.We will establish a legal system for surrogacy based on the principles of voluntariness,effective supervision and management,and non-profit use.
